BANDA ACEH, KOMPAS.com - Forum for the Environment Indonesia (WALHI) in Aceh found new evidence (Novum) for environmental damage due to road construction project in Aceh Ladia Galaska through protected forest area. Related Novum, the WALHI Aceh filed a judicial review (PK) of Supreme Court Decision, 2007, Thursday (31/03/2011) through Banda Aceh District Court.
WALHI Aceh Lawyer Team Member, M Zuhri Hasibuan, Friday (4/1/2011) in Banda Aceh, said that new evidence is collected WALHI Aceh through research at the site through which the Ladia Galaska road project and the surrounding environment in February 2011. Evidence was also presented in the form of formal rules that reinforce the claim of denial of the project.
"With this Novum, we propose PK and asked the Supreme Court to review the decision of case No. 27 / Pdt.G/2003/PN-BNA No.43/Pdt/2004/PT-BNA Jo Jo No. 1343 K / Rev / 2007. Galaskan Ladia project should be stopped because it threatens the sustainability of protected forest and Gunung Leuser National Park, "Zuhri said.
Ladia Galaska road construction projects have been proposed since 2002. The project was originally cross-linking between the path east to west across 470 kilometers of Aceh along with the plateau region through the Leuser. Ladia Galaska, the name of the pass is the abbreviation of the Indian Ocean-the Gayo-Alas-Strait of Malacca.
In 2003, WALHI Aceh began to sue the project because it can damage the protected forests and conservation areas, including Gunung Leuser National Park which is a habitat for millions of rare species that can not be found anywhere in the world.
Zuhri explained that a civil lawsuit against the Government of Indonesia and Aceh Government Ladia Galaska related cases it has been running since the year 2003-2004 at the Banda Aceh District Court as the court of first instance. In Banda Aceh District Court decision No.27/pdt.G/2003/PN-BNA rejected the lawsuit. Then, WALHI Aceh again appealed to the Court of Appeal, Banda Aceh. However, in 2007 PT decided also rejected the claims. WALHI Aceh Appeal to Supreme Court over the case even this was also rejected by the Supreme Court.
-Novum Novum new proposed WALHI Aceh in the PK of which the Government Regulation No. 28 of 1985 on Forest Protection.
